Estate law is governed by state law, so there are 50 different sets of rules for probate and estates in the United States. A call to your county courthouse can help you locate the office (sometimes called a Surrogate's office) that handles probate cases, and the staff should be able to answer this question. Also, if you are working with an attorney to settle the estate, the attorney should be able to assist you.
