Why is credit counseling required to file bankruptcy?

Last Updated: October 09, 2009

View as web page

Bankruptcy applicants must complete a two-hour credit counseling session with an approved credit counseling agency within six months before filing. Credit counseling became a requirement for bankruptcy in 2005 and was widely viewed as a way for debtors to explore all their debt repayment options before filing. A list of approved credit counselors is available in the "Credit Counseling and Debtor Education" section of the Department of Justice Office of U.S. Trustee's Web site at www.usdoj.gov/ust. Bankruptcy credit counseling sessions may be conducted in person, online, or by telephone.
