Can I file my own bankruptcy case (without a lawyer)?

Yes. Individuals may file their own bankruptcy case. However, bankruptcy law is complex, and the effects of a poorly carried out bankruptcy can have serious and long-term implications regarding property such as your home. So filing without an attorney is a step to consider very carefully.

Bankruptcy law was revised in October 2005. The revised law limits whether a person can file for Chapter 7 or Chapter 13 based on income and requires credit counseling prior to filing, among other changes. But none of the changes prohibit an individual from filing his or her own case. If you decide to take this step, try to seek assistance from a local legal clinic, law school, or community human services agency.
