Unfortunately, no. Depending on state law, a child in foster care becomes the ward of the state or county. The goal of foster care is to reunite the child with his/her parent(s). If the court finds that the parents are able and willing to meet the child’s needs, it will order the child to be returned to the parents. The court may decide that it is in the child’s best interests to live with someone other than the relative. In making a decision to move a child, the court must consider the relationship that the relative caregiver has developed with the child. The foster care provider does not have a legal right to the child or to participate in the court case.
