In order to place a child for adoption, a court must first terminate parental rights to the child. A petition for Termination of Parental Rights is usually filed by the county agency responsible for investigating reports of child abuse and neglect. The parents may consent to terminate their parental rights. If they do not consent, the court will conduct a closed hearing. If the petition is granted, guardianship is usually awarded to the state agency for child and family services. The state agency will seek an adoptive placement for the child.
